AGE RESTRICTIONS: One occupant must be over 55 - SEE Covenant

BILLIARDS / POCKET POOL: SEE posted rules.
BOARD MEETINGS: SEE Section 4.10 and 4.12 of the Bylaws.
The Board of Directors shall meet on the third Tuesday of each
month at 1:30 P.M.
BORROWING EQUIPMENT: Certain designated Association equipment may be borrowed by Homeowners by signing a statement listing the equipment and when it will be taken and returned. Statements available in Association Office.
CALENDAR OF ACTIVITES: The Social Director shall maintain a calendar of events in the Association Office. Those wishing to schedule an event must contact the Social Director to request the event being posted to the calendar.
COMPLAINTS: SEE Section 10 of the Covenants.
Violations of the Covenants, Reports of violations of the Covenants
shall be made in writing and signed by the complainant. In order
to address the Board the complainant must submit the above to
Association Office by 9:00 a.m. the Friday before the meeting
at which the complaint is to be presented.
COMPUTER & FAX MACHINE: Office use only
FEES: SEE section 3.3 of the Declarations.
Transfer of ownership: A $100 application processing fee will
be charged. Fee is non-refundable SEE Section 9.6 of Covenants.
Lease (rental} of homes: A $50 application processing fee will
be charged. This fee will be waived for residents who have previously
been approved for residency. Section 8.8 of the Declarations.
Rental of Association Facilities: CLUBHOUSE (Excluding offices and storage areas) $225 per diem, $50 of which will be refunded if there are no repairs or extraordinary cleaning required as a result of this use. Any repairs or cleaning in excess of $50 will be charged to the renter. KITCHEN/CARD ROOM $50 Per diem, $25 of which will be refunded if there are no repairs or extraordinary cleaning required as a result of this use. Any repairs or cleaning in excess of $25 will be charged to the renter.
Late Payment of Assessments and Dues: The fee for late payment of dues is $75. SEE: Section 3.5 of the Declarations.
FINES: SEE Section 10.3 of the Declarations. According to Florida State Law, a fine of $100 per incident, per day, not to exceed $1,000, may be imposed for violations of Protective Covenants.
FLAGS: All flags should be flown in accordance with accepted practices of U.S. Flag courtesy.
FITNESS EQUIPMENT:
Posted Rules: Users must obey posted rules and instructions for
use of equipment.
Liability Release: User must have a signed Liability
Release Form on file in the Association Office.
Age Restrictions: Only adults may use the equipment.
LAKES: Lake water may not be used for sprinkling or irrigation of any Lot.

LOCKS AND KEYS TO RECREATIONAL FACILITIES:
Keys to Recreational Facilities: Each Homeowner may obtain a card
to the Recreational Facilities and is responsible for its proper
use. The cost per card is $5.00. The cost per key for the tennis courts and equipment is $2.00
Proper Use of Cards: Cards may not be given or loaned to anyone
other than a resident or houseguest of a resident. The card user
is responsible to make sure that all locks and doors which the user unlocked
are locked when leaving the facility.
A Director or Supervisor of an activity is responsible to lock all locks and doors at the end of the activity.
MEDIANS: SEE RIGHT OF WAY
NEWSLETTER: The contents of the Newsletter shall be limited to Board news and announcements of Association social functions and activities.
PARKING: SEE Section 7.17 of the Declarations
Parking signs throughout the Community must be obeyed.
Parking for Day Trips: Residents are required to use the Overflow
Parking Area when leaving their vehicles for day-long trips.
Overnight Parking: Parking in common areas overnight is prohibited except with permission of The Board.
PARTICIPATION IN ASSOCIATION ACTIVITIES:
Priority: In activities in which there is a limit on the number
of participants, Residents will be accepted in the order in which
they enrolled or paid a fee or admission. Any remaining openings
will be assigned to overnight guests first and then to any other
guest.

PLANTS/PLANTING:
SEE Sections 7.12 and 7.14 of the Declarations and SEE RIGHT-OF-WAY.
POOL: SEE Swimming Pool or Billiards.
POSTED RULES AND REGULATIONS FOR COMMON AREAS: In various facilities of the Common Area rules are posted which have been adopted by the Board and have full force and effect. Only Board-adopted Rules and Regulations shall be posted.
RENTAL OF COMMON AREAS: SEE Fees
Open to Residents: Rental of a facility does not close it to residents.
Only Homeowners may rent facilities.
Attendance at Private Affairs must have mostly residents in attendance.
RIGHT-OF-WAY: The term "Right of Way" can generally be construed to mean the road and the area on each side to the inside edge of the sidewalks or where a sidewalk would be if it were installed. Planting of anything other than grass in the right-of-way is prohibited, except by Board approval and a permit from Collier County.
ROLLER BLADING is permitted ONLY in the Overflow Parking Lot.
SMOKING: Smoking is prohibited in the Clubhouse and Annex Building.
SOLICIT[NG: Soliciting is prohibited. SEE Section 7.8 of the Declarations.
SWALES: Care and maintenance of SWALES are the responsibility of the owner.
SWIMMING POOL:
Scheduled Activities: Pool activities scheduled on the Calendar
of Activities may have exclusive use of that portion of the pool
which is necessary, as determined by the director of the activity.
Other members and guests may use the remaining portion of the
pool.
Swimming is Permitted only from sunup to sunset.
Pool Use: No one may swim alone. There must always be two or more
people, one of whom is an adult, present.
Devices: Fins, snorkels, inflatable rafts and similar devices
are not permitted. However, an approved floatation device is required
for all non-swimmers.
Posted Rules must be obeyed.

ADDITIONS VIA BOARD MEETING APPROVALS:
Date of Meeting - August 6, 1996
Expenditure - Assessment: An expenditure in excess of $500 for maintenance of a capital improvement item must be approved by the Board.
Date of Meeting - September 3, 1996
Screening Committee: A personal interview is mandatory for all purchases of a Lot or previously built home as a precondition for approval.
Date of Meeting - January 21, 1997
Mailboxes: Recognizing the impossibility of attaining uniformity with respect to mailboxes, M/S Randazzo, Cunningham to eliminate mailboxes from the requirements of Item 5 of ARB Criteria. Approved

Fences, Walls: This refers to fences on lot lines that border the perimeter of the community, other than lot lines that border Riviera Golf Course, i.e. County Barn Road. The first resident building the first fence across the back border, approved by the Board of Directors and with County Permit, will and shall take precedence, and all fences shall be the same color, material and height.

Violations: If there is a violation, a letter will be sent, if this letter is ignored, a second letter will follow. The third letter will inform the resident to appear before the next Board of Director's Meeting. The fourth letter will inform the resident to appear before the Violations Committee to discuss the problem. The Violations Committee makes recommendations to the Board of Directors and they have the final say as to the course of action that will be taken.
