The Architectural Review Board (ARB) is one of the "operations" committees of the Board of Directors. It reviews all requests for external changes in the buildings, homes, grounds, and landscaping throughout the community. At the present time the committe members include: Dwight Kehoe, Chair Larry Pairitz Cliff Lingsch Dan Lyons Bill Adair Tom Savage Larry Larkin Architectural/Aesthetic Criteria The new Covenants grant authority to the ARB to propose written Architectural/Aesthetic Criteria for the Lots subject to the Declaration. In addition to some of the specific requirements which are set forth in the Declaration, the criteria are to set forth such things as landscape material, color and materials which the ARB finds acceptable. The criteria recommended by the ARB must be accepted by the Board in order to be effective. The ARB recommends that this document, or something similar to it, once it is approved by the Board, be distributed to new Lot owners during the interview session. Requirements contained in the Covenants: Structural Requirements o for Mobile Homes 1. Minimum 24 feet wide and 36 feet long. 2. Minimum 864 square feet of living space. 3. Minimum elevation of 16 inches and maximum of 20 inches. 4. Requires skirt enclosure and hurricane tie down. o Residences 1. No more than one story in height. 2. Minimum of 1,000 square feet of living area. 3. Requires two car garage. 4. Requires a concrete driveway. o Note: Plans submitted for both Mobile Homes and Residences must contain other information which is not included in this document but is contained in the Declaration of Covenants. Lawns: Non-constructed areas must be covered by lawns and landscaping. For example, stones, in lieu of grass, will not be approved. Fences: No fences or walls will be allowed, except for limited exceptions as provided for in Section 7.13 of the Covenants (see below.). Hedges: No hedge higher than three feet will be allowed unless it is located within three feet of the home, except for limited exceptions as provided in Section 7.14 of the Covenants (See below.). Yard Lights and Mailbox*: Must be installed and in a manner and shape consistent with others in the specific neighborhood. Additional Requirements for both Mobile Homes and Residences: Color: Only pastel colors will be acceptable for the base color (excluding trim) of a home. Samples of approved colors from various manufacturers are available in the Clubhouse. Pastel colors being a soft subdued color. Landscape: No plants or trees should be planted which would interfere with the illumination from the required yard light. No plants or trees may be planted in the easement between the sidewalk and the street. No plants or trees may be planted on or near the property line that would eventually encroach on the neighbors property. Materials: Residences, excluding mobile homes, must be primarily of Concrete, Block and Stucco construction unless an exception is recommended by the ARB and is approved by the Board of Directors. Additional Criteria for Architectural Review Board approved by the Board of Directors April 28, 1998 The installation of satellite dish antennas shall be consistent with the aesthetic requirement of the Governing Documents of the Rivera Golf Estates. Plans for such installations shall be submitted to the Architectural Review Board for approval. These plans should include the exact location of subject antenna and appropriate screening consistent with technical considerations. Additional Criteria for Architectural Review Board approved by the Board of Directors June 13, 2003 Fences, enclosures, and walls (around A/C units, waste containers, mechanical services, etc.) are not to exceed 54 inches in height and must be sturdily built of approved materials. A. Approved Materials Include: · cement block or · plastic, or · wood. · No wire fencing is allowed. B. Maximum enclosed area is not to exceed 4 feet by l2 inches. C. Color of materials" · white or · a color corresponding to color of home (not trim) D. If hedges are used around A/C units, waste containers, mechanical services, etc., they must conform to the above restrictions. E. Landscaping, especially trees, to be planted not to obscure neighbor's views. All outside structures including walkways, patios, etc. must be presented to the office, reviewed by the ARB Board with the final approval being made by the Board of Directors. This includes all of the items mentioned in this document. In order to allow adequate time to review plans submitted by Lot owners and obtain Board approval of ARB recommendations, we feel that three weeks is required to complete the review process. If additional information is required by the Board of Directors, please let one of the ARB members know. We understand that these criteria must be sent to the residents for review prior to adoption by the Board. If we can assist in that process, please, let us know. ------------------------------------------------------------------------ *Board Changes effective January 21, 1997: Recognizing the impossibility of attaining uniformity with respect to mail boxes, the Board of Directors voted unanimously to eliminate mail boxes from the requirements of Item 5 of the B Criteria. from the DECLARATION OF PROTECTIVE COVENANTS - 7.13 Fences: Walls. No fence or wall of any size, shape or material shall be allowed on any Lot without the prior written approval of the Board of Directors and the Architectural Review Board (ARB). The term "fence" shall be broadly construed and shall include any and all enclosures, trellises, lattices or any similar structure. Fences and walls must comply with the ARB, guidelines as approved by the Board of Directors from time to time. Fences up to a height allowed by law are allotted on Lot lines that border the perimeter of the community other than Lot lines that border Riviera Golf Course. 7.14 Hedges. No hedge greater than three (3) feet in height shall be allowed on any Lot unless it is located within three (3) feet of a Residence or utility shed. A variance on hedge height, at a height approved by the board, to residents adjacent to cart paths from holes 6 - 7, 8 - 9, and 17 - 18 and the homes adjacent to the County Barn Road entrance and along County Barn is permitted. In addition, hedges of up to a height allowed by law are allowed on Lot lines that border the perimeter of the community other than Lot lines that border Riviera Golf Course.
